Quotes and Pricing

All quotes provided through our Site or by our representatives are valid for 30 days unless otherwise specified. Prices are subject to change without notice. Equipment availability is subject to prior sale and may vary by location. We reserve the right to correct any errors in pricing or descriptions.

Equipment Sales

All equipment sales are subject to the following conditions:

• Payment terms are net 30 days unless otherwise agreed in writing
• Title and risk of loss pass upon delivery to the buyer
• Manufacturer warranties apply where applicable
• Returns are subject to our return policy and restocking fees

Equipment Rentals

Rental agreements are subject to the following terms:

• Rental rates are based on the agreed rental period
• Equipment must be returned in the same condition as received, normal wear excepted
• Renter is responsible for damage caused by misuse or negligence
• Fuel and consumables are the renter's responsibility
• Extensions must be requested before the rental period expires

Service and Repairs

Service work is performed according to manufacturer specifications and industry standards. Estimates are provided before work begins. Additional repairs discovered during service will be communicated for approval. We warranty our workmanship for 90 days. Manufacturer parts warranties apply where applicable.

Limitation of Liability

To the fullest extent permitted by law, Leavitt Machinery shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our Site or services. Our total liability shall not exceed the amount you paid for the specific product or service giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Leavitt Machinery, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Site or services.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. Any disputes shall be resolved in the state or federal courts located in King County, Washington.

Severability
